SnapBay Terms of Service

By downloading, installing, or using SnapBay, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.
1. Service Description
SnapBay is a mobile application that helps users create eBay listings using AI-powered photo analysis and description generation. Our service includes:
- AI-powered product description generation from photos
- eBay listing creation and management
- Category suggestion and pricing assistance
- Image upload and processing services
- Multiple subscription tiers with varying feature sets
2. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and SnapBay, a CodeAlpha™ brand ("we," "us," or "our"). By using SnapBay, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
3. Eligibility
To use SnapBay, you must:
- Be at least 18 years old or have parental consent
- Have a valid eBay account in good standing
- Comply with eBay's Terms of Service and policies
- Provide accurate and complete information during registration
- Be legally capable of entering into binding contracts
4. User Account and Registration
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring your eBay account remains in good standing
- Notifying us immediately of any unauthorized use of your account
- Providing accurate and up-to-date information
5. Subscription Plans and Pricing
5.1 Current Plans
SnapBay offers the following subscription tiers:
- Free Plan: 5 initial listings + 3 listings per month, 1 photo per listing
- Pro Plan: Unlimited listings, up to 5 photos per listing, auction support
- Unlimited Plan: All Pro features + up to 12 photos per listing, priority support
5.2 Plan Modification Rights
IMPORTANT: We reserve the right to modify, suspend, or discontinue any subscription plan, pricing, or features at any time with or without notice. This includes but is not limited to:
- Changing subscription prices
- Modifying plan features and limitations
- Adding or removing subscription tiers
- Adjusting usage limits (photo counts, listing limits, etc.)
- Discontinuing the service entirely
Changes will be communicated through the app, email (for paid subscribers), or by posting updated terms on our website. Continued use of the service after changes constitutes acceptance of new terms.
5.3 Billing and Payments
- Subscriptions are billed through Apple App Store or Google Play Store
- Billing cycles are monthly or yearly as selected
- Subscriptions auto-renew unless cancelled before the renewal date
- Price changes will apply to subsequent billing cycles
- No refunds for partial months or unused features
5.4 Cancellation
- You may cancel your subscription at any time through your device's app store settings
- Cancellation takes effect at the end of the current billing period
- Access to premium features will be reverted to Free plan limits upon cancellation
- We may cancel your subscription for violation of these terms
6. Acceptable Use Policy
6.1 Permitted Uses
You may use SnapBay to:
- Create legitimate eBay listings for items you own or have permission to sell
- Generate product descriptions and manage your eBay inventory
- Upload photos of items you intend to sell
6.2 Prohibited Uses
You may NOT use SnapBay to:
- Create listings for prohibited, illegal, or restricted items
- Upload inappropriate, copyrighted, or misleading images
- Violate eBay's policies or terms of service
- Engage in fraudulent or deceptive practices
- Attempt to reverse engineer or hack the application
- Share your account credentials with others
- Use automated tools or bots to interact with the service
- Create multiple accounts to circumvent usage limits
7. eBay Integration and Compliance
SnapBay integrates with eBay's services through official APIs. By using SnapBay:
- You agree to comply with all eBay terms, policies, and guidelines
- You authorize SnapBay to access your eBay account for listing creation
- You acknowledge that eBay may reject or remove listings that violate their policies
- You understand that eBay account suspension may affect SnapBay functionality
- You are solely responsible for the accuracy and legality of your listings
8. Intellectual Property
8.1 SnapBay's Rights
SnapBay, its design, functionality, and content are owned by CodeAlpha™ and protected by intellectual property laws. You may not:
- Copy, modify, or distribute the app or its content
- Use our trademarks, logos, or branding without permission
- Create derivative works based on SnapBay
8.2 User Content
You retain ownership of photos and content you upload. However, by using SnapBay, you grant us:
- A limited license to process your images for AI analysis
- Permission to temporarily store images for eBay integration
- The right to use anonymized data for service improvement
9. Disclaimer of Warranties
SnapBay is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We specifically disclaim:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any guarantee that the service will be uninterrupted, secure, or error-free
- Responsibility for eBay listing success, sales results, or account issues
- Accuracy of AI-generated descriptions, categories, or pricing suggestions
- Availability of third-party services (eBay APIs, payment processors)
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our total liability shall not exceed the amount you paid for SnapBay in the 12 months preceding the claim
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- We are not responsible for lost profits, data loss, or business interruption
- We are not liable for issues arising from eBay account suspension, listing rejections, or sales disputes
- You use SnapBay at your own risk and are solely responsible for your eBay listings and compliance
11. Indemnification
You agree to indemnify and hold harmless SnapBay, CodeAlpha™, and our affiliates from any claims, damages, or expenses arising from:
- Your use of the service or violation of these Terms
- Your eBay listings, sales, or disputes with buyers
- Violation of any third-party rights or applicable laws
- Inaccurate or misleading information in your listings
12. Termination
12.1 Termination by You
You may terminate your account at any time by:
- Cancelling your subscription through your device's app store
- Contacting us at support@snapbay.app for account deletion
- Uninstalling the app (though data may remain until formal deletion request)
12.2 Termination by Us
We may suspend or terminate your account immediately if:
- You violate these Terms or our Acceptable Use Policy
- Your eBay account is suspended or terminated
- You engage in fraudulent or illegal activities
- We discontinue the service
- Required by law or eBay's policies
12.3 Effect of Termination
Upon termination:
- Your access to SnapBay will cease immediately
- Unused subscription time is not refundable
- Your data will be deleted according to our Privacy Policy
- These Terms will remain in effect for past activities
13. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using SnapBay, you consent to our data practices as described in the Privacy Policy.
14. Changes to Terms
We may modify these Terms at any time to reflect:
- Changes in our service offerings or pricing
- Legal or regulatory requirements
- Security or operational improvements
- Business model changes or cost management needs
Material changes will be communicated through the app, email, or by posting updated Terms on our website. Continued use after changes constitutes acceptance of the new Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of Texas, United States, without regard to conflict of law principles. Any disputes will be resolved through:

- Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration in Texas
- Small Claims Court: Either party may pursue claims in small claims court for qualifying disputes
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SnapBay regarding your use of the service.
